Affiliate Program Agreement

The terms governing participation in the Ftytrade Affiliate Program — commissions, payouts and marketing rules.

Last updated: October 1, 2026

A. THE AGREEMENT

1. Parties & Acceptance

1.1 This Affiliate Program Agreement (the "Agreement") is entered into between FTY MARKET LLC, a limited liability company registered in the State of Wyoming, United States, doing business as Ftytrade Futures ("Ftytrade", "we", "us", "our"), with its registered address at 107 S Broadway Ave, Riverton, WY 82501, United States, and you, the individual or legal entity that enrols in the Ftytrade Affiliate Program (the "Affiliate", "you", "your").

1.2 You accept this Agreement by activating your affiliate code or referral link in the Affiliate section of the Ftytrade Platform, or by otherwise using the Program. If you enrol on behalf of a company or organisation, you represent that you have authority to bind it, and "you" includes that entity.

1.3 This Agreement takes effect on the date of acceptance (the "Effective Date") and continues until terminated under Section 28.

2. Relationship to Other Documents

2.1 This Agreement supplements our Terms & Conditions, Privacy Policy, Cookie Policy and Risk Disclosure (together with this Agreement, the "Documents"), which continue to apply to you.

2.2 Where this Agreement and the Terms & Conditions cover the same subject in relation to the Affiliate Program, this Agreement prevails.

2.3 Capitalised terms not defined here have the meaning given in the Terms & Conditions.

3. Definitions

4. Eligibility

4.1 To participate in the Program you must:

4.2 Traders may be affiliates. Holding a Challenge, Fty Direct or Funded Account does not prevent you from participating in the Program, provided that you have your own audience or community and comply with Section 9.3 (no self-referrals) and Section 19.

4.3 We may refuse, suspend or revoke participation at our reasonable discretion, in particular where we consider your channels, content or audience inconsistent with our brand or with the law.

B. HOW THE PROGRAM WORKS

5. Enrolment & Approval

5.1 Enrolment is made through the Affiliate section of the Platform. On activation you receive an Affiliate Code and a Referral Link.

5.2 We may review your application, your channels and your content before or after activation, and may request information about how you intend to promote Ftytrade.

5.3 Your Affiliate Code and Referral Link are personal and may not be transferred, sold or shared with other affiliates.

6. Referral Links, Codes & Attribution

6.1 Attribution by code. A purchase in which the Referred Customer enters your Affiliate Code at checkout is attributed to you.

6.2 Attribution by link — first click. A purchase made after the customer clicks your Referral Link is attributed to you under a first-click rule: if a customer has clicked more than one affiliate's link, the purchase is attributed to the affiliate whose link was clicked first, within the tracking window of [30 days] from that click. If the customer enters a different Affiliate Code at checkout, the code entered at checkout prevails.

6.3 New and existing customers. Both new customers and existing Ftytrade customers may be Referred Customers, provided that they use your Affiliate Code or Referral Link for the relevant purchase. Attribution applies per purchase, not permanently to the customer.

6.4 Our records are final. Attribution is determined exclusively from the tracking data recorded by our systems. We do not attribute purchases on the basis of screenshots, customer statements or external analytics, and we do not attribute purchases retroactively.

6.5 Tracking limitations. Tracking may fail where the customer blocks cookies, uses a different device or browser, clears browsing data, or does not enter the code at checkout. We are not responsible for lost attribution caused by these limitations.

7. Customer Discount

7.1 When a Referred Customer uses your Affiliate Code at checkout, a Customer Discount of 5% to 10% of the list price is applied. The exact percentage depends on the current offer and on your Tier, as shown in the Affiliate section of the Platform at the time of purchase.

7.2 The Customer Discount cannot be combined with other promotional codes unless we expressly state otherwise.

7.3 We may change the Customer Discount for future purchases at any time. Changes do not affect purchases already completed.

8. Tiers & Commission Rates

8.1 The Program has three Tiers. Your Commission rate depends on your Tier at the time of the Qualifying Purchase:

TierCommission rate (on Net Amount)
Tier 18%
Tier 210%
Tier 312%

8.2 Promotion between Tiers. You advance to the next Tier when you reach the number of Qualifying Purchases required for that Tier, as displayed in the Affiliate section of the Platform. The thresholds are determined by Ftytrade and are shown in your panel.

8.3 Changes to thresholds and rates. Ftytrade may modify the Tier thresholds, the Commission rates and the Customer Discounts at any time under Section 31. Changes apply to Qualifying Purchases made after the effective date of the change; Commissions already earned are not affected.

8.4 Downgrade. We may review your Tier periodically. Where Qualifying Purchases are reversed under Section 13 and your total falls below the threshold of your current Tier, your Tier may be adjusted accordingly.

C. COMMISSIONS

9. Qualifying Purchases

9.1 A Qualifying Purchase is any of the following, made by a Referred Customer and attributed to you under Section 6: a Challenge Account (Challenge Rapid or Challenge Steady), a Fty Direct Account, a Reset, and any other product we designate as commissionable in the Platform.

9.2 The following are not Qualifying Purchases: purchases that are refunded, cancelled or subject to a chargeback; purchases made with another affiliate's code; purchases found to be fraudulent or made in breach of the Terms & Conditions; purchases of products we have excluded from the Program; and purchases made by you or by any person acting on your behalf.

9.3 Self-referrals are prohibited. You may not use your own Affiliate Code or Referral Link for your own purchases, for purchases made by members of your household, or for purchases paid with your payment methods. Self-referrals are a Breach of this Agreement and all related Commissions are void.

10. Commission Calculation

10.1 Commission is calculated as your Tier rate multiplied by the Net Amount of the Qualifying Purchase, that is, the amount the customer actually pays after the Customer Discount, excluding taxes and payment-processing fees.

Example. List price USD 300. Customer Discount 10% → Net Amount USD 270. You are in Tier 2 (10%). Commission = USD 27.00. At payout, the 3.7% provider fee (Section 12.4) is deducted: you receive USD 26.00.

10.2 Commission is calculated in US dollars. Where the customer pays in another currency or in cryptocurrency, the Net Amount is the USD value recorded by our payment processor at the time of purchase.

10.3 Commission is earned on each Qualifying Purchase individually. There is no limit to the number of Qualifying Purchases that may be attributed to you.

11. Holding Period

11.1 Every Commission remains pending for a Holding Period of [30 days] from the date of the Qualifying Purchase. The Holding Period allows refunds, chargebacks and fraud reviews to be processed before the Commission becomes payable.

11.2 At the end of the Holding Period, a Commission on a purchase that has not been refunded, disputed or reversed becomes payable and is added to your available balance.

11.3 We may extend the Holding Period for a specific Commission where a review is in progress, and will tell you that a review is open.

12. Commission Payouts

12.1 Frequency. Payable Commissions are paid at the end of each calendar month, for all Commissions that became payable during that month, provided that the minimum in Section 12.2 is met.

12.2 Minimum. The minimum payout is USD 249. If your payable balance is below the minimum at month end, it carries over to the following month.

12.3 Method. Payouts are made through the official method published in the Affiliate section of the Platform, currently USDT ([ERC-20]). We may add or change methods at any time. The wallet or account must be in your own name (or in the name of your registered entity).

12.4 Provider fee. A payment provider fee of 3.7% is deducted from each Commission payout.

12.5 Verification before payment. Before your first payout, and at any time afterwards, you must complete verification:

12.6 Tax forms. We may require IRS Form W-8BEN (non-US individuals), W-8BEN-E (non-US entities) or W-9 (US persons) before paying you.

12.7 Your payout details. You are solely responsible for the accuracy of the wallet address, network and account details you provide. Cryptocurrency transfers are irreversible; we are not liable for funds sent to an incorrect address or network that you entered, and such funds are considered paid.

12.8 Costs. Network fees, conversion costs and any fee charged by your wallet or provider beyond the fee in Section 12.4 are your responsibility.

12.9 No interest. Pending or carried-over balances do not bear interest.

13. Reversals, Clawback & Set-Off

13.1 Reversal. A Commission is reversed, and removed from your pending or payable balance, where the related purchase is refunded, cancelled, subject to a chargeback, found to be fraudulent, made in breach of the Terms & Conditions, or made by a customer whose account is terminated for a Breach within the Holding Period.

13.2 Clawback. Where a Commission has already been paid and we subsequently establish that it was earned through a reversed purchase, a self-referral, fraud, a Prohibited Marketing Practice or an error, you agree to repay it on demand. We may deduct the amount from any future Commission.

13.3 Set-off. We may set off against any Commission any amount you owe us under this Agreement or the Terms & Conditions, including amounts arising from your own purchases, chargebacks or repayment obligations.

13.4 Errors. If a Commission is paid in excess of the correct amount because of an error, you must notify us and return the excess. We may deduct it from future Commissions.

14. Taxes

14.1 You are solely responsible for all taxes, VAT, social contributions, registrations and declarations that apply to Commissions in your country.

14.2 Commissions are paid gross. We do not withhold taxes unless required by law; if required, we will deduct the amount and inform you.

14.3 Where applicable law requires you to invoice us for Commissions (for example, as a VAT-registered business), you must issue a compliant invoice for each payout on request.

14.4 We do not provide tax advice.

15. Leaderboard & Statistics

15.1 You grant Ftytrade a non-exclusive, royalty-free licence to display your nickname, Tier, number of referrals and Commission statistics on the affiliate leaderboard and in Program communications.

15.2 We will not publish your full name, email address or payout details without your separate consent.

15.3 You may opt out of the public leaderboard by writing to [partners@ftytrade.com].

D. MARKETING RULES

16. Permitted Marketing Channels

16.1 You may promote Ftytrade through: your own website or blog; your own social media profiles and channels (YouTube, X, Instagram, TikTok, Twitch, Telegram, Discord and similar); your own email list, where recipients have given valid consent; your own community, course or membership; and live streams and videos in which you trade Ftytrade accounts, subject to Section 19.

16.2 Paid advertising. You may run paid advertising (Google Ads, Meta Ads, TikTok Ads, display or native advertising) that promotes your Affiliate Code or Referral Link only with the prior written approval of the Ftytrade Affiliate Program team, and in coordination with your assigned affiliate manager. Approval may be conditioned on campaign targeting, creatives, landing pages, budget and reporting, and may be withdrawn at any time. Unapproved paid campaigns are a Prohibited Marketing Practice.

16.3 Coupon and deal websites. Publishing your Affiliate Code on coupon, voucher or deal websites is not permitted unless we authorise it in writing.

17. Prohibited Marketing Practices

You must not, directly or through any third party:

Claims and representations

Brand and traffic

Integrity

18. Mandatory Disclosures

18.1 Affiliate disclosure. In every piece of content that includes your Affiliate Code or Referral Link, you must disclose clearly and conspicuously that you receive a commission from Ftytrade. The disclosure must be visible before the link, not hidden in a "read more" section, and must comply with the FTC Endorsement Guides (16 C.F.R. Part 255) in the United States and with the advertising and consumer-protection rules of the countries you target (including the EU Unfair Commercial Practices Directive and the UK CAP Code).

18.2 Risk disclaimer. Any content that shows, discusses or implies trading results, Payouts or Funded Accounts must include the short-form risk disclaimer published in our Risk Disclosure (Section 4.3), or a link to it, and the CFTC Rule 4.41 hypothetical-performance disclaimer where simulated results are shown.

18.3 Suggested wording: *"I'm a Ftytrade affiliate and earn a commission if you purchase through my link. Ftytrade accounts are simulated; trading futures involves substantial risk of loss. Read the full Risk Disclosure at ftytrade.com/risk-disclosure."*

19. Brand & Trademark Use; Streaming and Trading Content

19.1 Licence. We grant you a limited, non-exclusive, revocable, royalty-free licence to use the Ftytrade name, logos and marketing materials that we provide, solely to promote the Program in accordance with this Agreement. You must use the materials as provided, without modification, and must not combine our marks with other marks or use them in a way that suggests we endorse your other products.

19.2 Materials. Approved logos, banners and copy are available from the Affiliate section of the Platform or on request from your affiliate manager.

19.3 Streaming and trading content. You may live-stream, record and publish content in which you trade Ftytrade accounts, provided that you:

19.4 All rights not expressly granted are reserved. The licence ends automatically on termination of this Agreement.

20. Content Review, Takedown & Reporting

20.1 Review. We may review any content in which you promote Ftytrade or use our marks. On request, you must provide links to, or copies of, that content.

20.2 Non-disparagement. While you participate in the Program and receive Commissions from Ftytrade, you must not publish statements about Ftytrade, its staff, its partners or its services that are false, misleading, defamatory or made in bad faith, including fabricated or staged "experiences", fake reviews or fake complaints. Honest, factual and good-faith criticism is not prohibited.

20.3 Takedown. If we notify you that content breaches this Agreement, you must correct or remove it within 48 hours. Failure to do so is a Breach.

20.4 Reporting to platforms. You acknowledge and agree that, where content you publish about Ftytrade is false, misleading, defamatory, infringes our trademarks or copyrights, impersonates Ftytrade, or otherwise breaches this Agreement, Ftytrade may report that content to the hosting platform (including YouTube, Meta, TikTok, X, Twitch, Discord or any other platform) under that platform's trademark, copyright, impersonation, harassment or community-guideline procedures, which may result in removal of the content, strikes against your channel or account, or other action by the platform. By accepting this Agreement you acknowledge this right and agree not to contest, on the basis of this Agreement, a report made in good faith.

20.5 This Section does not limit any other remedy available to Ftytrade under this Agreement or the law.

21. Compliance with Laws

21.1 You must comply with all laws that apply to your marketing activity, including advertising and consumer-protection laws, financial promotion rules in your country, anti-spam laws (including CAN-SPAM, the EU ePrivacy rules and the UK PECR), data-protection laws (including GDPR and UK GDPR where you collect personal data), platform terms of service and intellectual-property laws.

21.2 Where financial promotion rules in your country restrict the promotion of trading-related services, you are responsible for ensuring that your content is permitted there.

21.3 You must not target or promote the Services to minors or to residents of Restricted Countries.

E. STATUS AND OBLIGATIONS

22. Independent Contractor

22.1 You act as an independent contractor. You are not an employee, worker, partner, joint venturer, agent or legal representative of Ftytrade, and nothing in this Agreement creates a franchise, agency or exclusive relationship.

22.2 You are not entitled to any salary, benefits, insurance, expense reimbursement or employment protection. Your only entitlement is to Commissions that meet the conditions of this Agreement.

22.3 You have no authority to make offers, accept orders, give warranties, negotiate terms, or make statements on behalf of Ftytrade, and you must not hold yourself out as having such authority.

22.4 The Program is non-exclusive: you may promote other firms, and we may engage other affiliates.

23. Affiliate Representations & Warranties

You represent and warrant, on the Effective Date and throughout the Agreement, that: (a) all information you have provided is true, accurate and complete; (b) you own or control the channels through which you promote Ftytrade; (c) you will not generate fraudulent, artificial or incentivised traffic; (d) your content complies and will comply with Sections 17 to 21; (e) your payout details belong to you; (f) you are not subject to sanctions and are not located in a Restricted Country; and (g) you have the authority to enter into this Agreement.

24. Confidentiality

24.1 You must keep confidential, and use only for the purposes of this Agreement: non-public information about the Program (including custom rates, thresholds or offers negotiated with you), conversion and referral data, our internal processes and systems, communications with our team, and any information marked or reasonably understood to be confidential.

24.2 This obligation does not apply to information that is public, that you must disclose by law (with notice to us where lawful) or that you disclose to a professional adviser bound by confidentiality.

24.3 This Section survives termination for 3 years.

25. Data Protection

25.1 Through the Platform you see only aggregated and pseudonymous statistics about your referrals (number of clicks, sign-ups, purchases, Commissions). You do not receive the names, email addresses or other personal data of Referred Customers, and you must not attempt to identify them.

25.2 If you collect personal data in your own channels (for example, through an email list or a form), you are the controller of that data and are solely responsible for complying with applicable data-protection law, including obtaining valid consent before sending marketing and before passing any data to us.

25.3 You must not transfer personal data to us except where we expressly request it and you have a lawful basis to do so.

26. Non-Disparagement & Good Faith

The obligations in Section 20.2 apply in all your communications, public or private, including in trading communities, review sites and private groups. You may report concerns about the Services to us at [partners@ftytrade.com] or support@ftytrade.com at any time.

F. END OF THE AGREEMENT

27. Monitoring & Audit

27.1 We monitor Program traffic, conversions and content automatically and manually. We may analyse click patterns, IP addresses, devices, conversion rates, refund and chargeback rates and content to detect Prohibited Marketing Practices.

27.2 On request, you must provide within 7 days information about your traffic sources, campaigns, creatives and the channels through which referrals were generated.

27.3 Commissions may be held under Section 11.3 while an audit is in progress.

28. Suspension & Termination

28.1 By you. You may leave the Program at any time by notifying [partners@ftytrade.com]. Payable Commissions that have completed the Holding Period will be paid at the next monthly payout, subject to the minimum in Section 12.2 and to Section 13.

28.2 By us, for cause. We may suspend or terminate your participation immediately, and forfeit all pending and payable Commissions, if: (a) you breach Sections 17, 18, 19, 20 or 21; (b) we identify self-referrals, fraudulent or artificial traffic, or identity misuse; (c) any representation in Section 23 is or becomes untrue; (d) you fail or refuse verification; (e) you file an unjustified chargeback or your Referred Customers generate an abnormal refund or chargeback rate attributable to your promotion; (f) you become subject to sanctions or are located in a Restricted Country; (g) you abuse or threaten our staff; or (h) we are required to do so by law.

28.3 By us, without cause. We may terminate your participation, or the Program as a whole, for any other reason by giving you 14 days' notice by email. In that case, Commissions that have completed or that complete the Holding Period by the termination date will be paid at the next monthly payout, without application of the minimum in Section 12.2.

28.4 Suspension for investigation. We may suspend your Affiliate Code and Referral Link, and hold Commissions, while we investigate a suspected Breach, acting with reasonable speed and keeping you informed.

29. Inactivity

29.1 If your Affiliate Code and Referral Link generate no Qualifying Purchases for 2 consecutive months, we may pause them. We will notify you by email 14 days before pausing.

29.2 A paused code or link stops tracking new referrals. You may request reactivation by writing to [partners@ftytrade.com]; reactivation is at our discretion.

29.3 Payable Commissions earned before the pause remain payable under Section 12.

30. Effect of Termination

30.1 On termination, your Affiliate Code and Referral Link are deactivated, the licence in Section 19 ends, and you must stop using our name, marks and materials and remove them from your channels within 7 days.

30.2 Purchases made after termination are not attributed to you.

30.3 Sections 13, 14, 20.4, 22, 24, 25, 30, 32, 33 and 34 survive termination, together with any other provision that by its nature should survive.

G. LEGAL

31. Program Changes

31.1 We may amend this Agreement, the Tiers, the Commission rates, the Customer Discounts, the thresholds, the payout methods and the marketing rules from time to time.

31.2 We will give you 14 days' notice of material changes by email or through the Platform, unless a shorter period is required by law or to prevent abuse.

31.3 Changes apply to Qualifying Purchases made after the effective date. Commissions already earned are not affected.

31.4 If you do not agree with a change, you may leave the Program under Section 28.1 before it takes effect. Continued participation after the effective date constitutes acceptance.

32. Limitation of Liability & Indemnification

32.1 Sections 25 (Disclaimer of Warranties) and 26 (Limitation of Liability) of the Terms & Conditions apply to this Agreement as if set out here in full. To the fullest extent permitted by law, our total liability to you under this Agreement is limited to the Commissions payable to you in the 6 months before the event giving rise to the claim.

32.2 We do not guarantee any level of traffic, conversions, Commissions or availability of tracking.

32.3 You agree to indemnify, defend and hold harmless Ftytrade and its members, managers, officers, employees, contractors and affiliates from and against any claims, liabilities, damages, losses, fines, regulatory actions, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your marketing content and activities; (b) any statement, promise or representation you make about Ftytrade or the Services; (c) your breach of this Agreement or of any law, including advertising, financial-promotion, anti-spam and data-protection laws; (d) your use of our marks outside the licence in Section 19; (e) claims by Referred Customers or third parties relating to your conduct; and (f) taxes due on amounts paid to you.

32.4 Nothing in this Agreement limits liability that cannot be limited under applicable law.

33. Governing Law & Dispute Resolution

33.1 This Agreement is governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules.

33.2 Section 32 (Dispute Resolution) of the Terms & Conditions applies to this Agreement in full, including the requirement to contact us first at [legal@ftytrade.com], binding individual arbitration administered by the [American Arbitration Association], the class action and jury trial waiver, the small-claims exception, the 30-day opt-out right and the exception for consumers resident in the European Union or the United Kingdom.

33.3 Notwithstanding the above, Ftytrade may seek injunctive or other equitable relief in any court with jurisdiction to stop a breach of Sections 17, 19, 20 or 24.

34. General Provisions

34.1 Entire agreement. This Agreement, together with the other Documents and any written custom terms agreed with your affiliate manager, is the entire agreement between you and us regarding the Program and replaces any prior understanding.

34.2 Assignment. You may not assign or transfer this Agreement, your Affiliate Code or your Referral Link. We may assign this Agreement to an affiliate or in connection with a merger, acquisition or sale of assets, provided your rights are not reduced.

34.3 Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full effect.

34.4 No waiver. Our failure or delay in enforcing a right is not a waiver of that right.

34.5 Language. This Agreement is written in English. Translations are provided for convenience only. If there is any discrepancy, the English version prevails, to the extent permitted by law.

34.6 Notices. We may give notice to you by email to the address on your profile or through the Platform. You must give legal notices to us by email to [legal@ftytrade.com], with a copy by post to our registered address.

34.7 Electronic acceptance. You accept this Agreement by activating your Affiliate Code or Referral Link. We record the date and time of acceptance, your IP address, your user ID and the version of this Agreement accepted. You may request a copy of the accepted version from [partners@ftytrade.com].
